Policies

Our office hours are Monday through Friday, 9:00 am to 5:00 pm.

Check-in is 4:00 pm and check-out is 10:00 am, no exceptions. If this presents a problem with your flight times, an early arrival or late check out may be possible, as available, with an additional fee.

All units are non-smoking units.  Any sign that guests have smoked on or near premises may be cause for forfeiture of entire security deposit.

STANDARD RENTAL TERMS

 

 All occupants, hereinafter referred to as “guest”, agree to the following:

 

1. Guest understands that each unit is privately owned, including the furnishings, with Na Pali Properties, Inc. acting solely as Agent for the Owner.  Unit may not be sublet nor rental assigned without prior consent from Na Pali Properties, Inc.  Guest agrees to hold harmless and indemnify the Owner and Agent from any and all costs, expenses, legal proceedings, legal fees, suits, claims, or demands, whether from injury or loss of life to Guest and/or invitees of Guest, unless same was due solely to the willful act or gross negligence of the Owner or Agent.  You are welcome to use any beach supplies and recreational equipment at your own risk and provided that you will assume all liability associated with the use of these items.

 

2. Na Pali Properties, Inc. maintains the right to enter for the following reasons: a. to make necessary or agreed repairs; b. to supply services agreed upon; c. if unit is for sale, we will give you 24 hours advance notice to show the unit at reasonable hours, d. in case of an emergency Na Pali Properties, Inc., and/or its agents, reserve the right to enter at any time for the purpose of safe keeping or prevention of further damage. NOTE:  Please notify us if you will be absent from the property  for more than 2 days.

 

3. Landlord responsibilities: We will give you the right to occupy unit in accordance with this agreement.  We will provide and maintain appliances.  We will not be held liable for any interruption of services that are beyond our control.  Please promptly notify Na Pali Properties, Inc. of any interruption(s) of said services.  Guest may not end this agreement due to interruption(s) of said services.  There will be no refunds or adjustments of the rent.

 

4. Tenant(s) responsibilities:  You will notify Na Pali Properties, Inc. of any defects or problems within the unit in a timely manner.  Use of the unit is intended as a temporary vacation residence.  Guest may not use it for any unlawful, improper or offensive purpose. No large parties, weddings or similar events are allowed.  No pets are allowed in unit.  No smoking is allowed in unit - you must be 20 feet away from all windows or enterances of buildings.  No disturbances: Guest will not disturb others or keep them from enjoyments of common areas.  Please obey all house rules posted in the unit.  Quiet hours on Kauai are 9:00 pm - 7:00 am - no exceptions.  Guest acknowledges that this reservation is only for persons listed within this contract. Children of all ages are included in the number of guest allowed at all locations.  If terms of agreement are broken by Tenant the result will be forfeiture of full security deposit.

 

5. Security Deposit: Na Pali Properties, Inc. will use security deposit to pay for any excessive cleaning required for the unit, to pay for long distance phone calls, to pay for damages caused by guests, replace missing or damaged inventory (this includes beach towels and chairs), and replace unreturned keys.  The charge for lost keys will be $25 per key. 

 

7. Guests are required to leave unit in the same general condition as when they check in.  Prior to departure guests should remove all trash, and put dishes in the dishwasher.  The cleaning charge is estimated for standard departure cleaning only.  Na Pali Properties, Inc. will attempt to return the deposit within 30 days after departure, but reserves the right to retain the deposit up to 45 days after departure.

 

8. Housekeeping: The property will be cleaned and prepared prior to Guest’s arrival.  Fresh linens and towels are placed in the property, along with a starter supply of soaps and paper products.  There may be various condiments and spices left in the kitchen, but it is not guaranteed.  Additional supplies are the responsibility of the Guest.  Maid service is NOT included, but may be arranged at an extra charge prior to your arrival.  Mid-stay cleaning(s) may be required for extended (beyond 2 weeks) rental periods at Guest’s expense.

 

9. Guests must arrive (4 pm) and depart (10 am) from unit on the date and time designated, unless we approve of additional time.  Any early arrival or late check out without prior approval will be subject to a penalty of no less than one half a day of rent.

 

10. If Na Pali Properties, Inc. cooperates with another agency in securing the rental, we will not be held responsible for their course of action. 

 

9.  Na Pali Properties, Inc. unilaterally, and at its sole discretion, reserves the right to change or cancel this reservation if conditions beyond our control render the unit unavailable for occupancy.  Should the property be made unavailable we will make every effort to substitute a similar property.  If no other property is available our liability will be limited to a refund of any pre-paid rents, taxes and cleaning fees paid by the Guest.
